Environmental Health Department <br />CP22 - HMBP Inspection Report <br />Date: <br />August 15, 2024 <br /> Facility Address: <br /> 1049 E MARCH LN, STOCKTON <br /> Facility Name: <br /> MCDONALDS #11797 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more <br />increase in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous <br />materials c) A change of business or facility address d ) Change business ownership e) Change of <br />business name f)(1) A substantial change in the handler 's operations occurs that requires modification to any <br />portion of the business plan. (2) For the purpose of this subdivision, “substantial change” means any change in <br />a facility that would inhibit immediate response during an emergency by either site personnel or emergency response <br />personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational <br />knowledge of the facility, or impede implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br />CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information <br />electronically submitted. <br />OBSERVATION: The following were found on site that have not been reported to CERS: <br />- SIX 250 Cu ft CO2 cylinders <br />- TWO 450 Cu ft CO2 cylinders <br />REGULATION GUIDANCE: Any material that meets or exceeds the reportable quantity shall be reported in the <br />facility's business plan. <br />CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval. <br />This is (Minor) Violation. <br /> 10 <br />CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br />for a minimum of three years. <br />OBSERVATION: At time of inspection, training records were not available on site. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or <br />threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and <br />procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the <br />unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential <br />harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate <br />notice, for the business site.
