The following is an itemized list of CP22 - HMBP violations that have not been <br />addressed for BOBS TOWING as of December 30, 2024. <br />Page 1 of 3 <br /> <br /> <br /> <br /> <br />Open violations from August 02, 2024 inspection <br />Violation #4 - 1010008 - Business plan reviewed and electronically certified as complete/accurate on or <br />before the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental <br />Reporting System (CERS) annually by the due date, January 15. A CERS submittal has not been made since <br />6/15/2017. <br /> <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year <br />and may be submitted beginning November 1 of the previous year. <br /> <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br /> <br /> This violation was corrected <br /> Supporting documents included <br /> This violation will be corrected by (date): <br />Describe actions taken or will be taken to correct violation: <br /> <br /> <br /> <br /> <br /> <br />Violation #5 - 1010006 - Updated within 30 days of 100% increase or new haz; change of <br />address/owner/name; or change in ops. <br />OBSERVATION: During the inspection, a 300 gallon poly tote, almost half filled, was observed on-site. This tote was <br />estimated to contain about 150 gallons of Diesel Exhaust Fluid (DEF). Only 55 gallons of DEF was reported on the <br />hazardous materials inventory. <br /> <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br /> <br />a) A 100 percent or more increase in the quantity of a previously disclosed material. <br />b) Any handling of a previously undisclosed hazardous materials <br />c) A change of business or facility address <br />d) Change business ownership <br />e) Change of business name <br />f)(1) A substantial change in the handler's operations occurs that requires modification to any portion of the business <br />plan. <br />(2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede <br />implementation of the business plan. <br /> <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.
