<br /> <br />Central Valley Regional Water Quality Control Board <br />30 September 2024 <br /> <br />Hammer Landing, LLC <br />333 West El Camino Real, Suite 240 <br />Sunnyvale, CA 94087 <br /> <br />FURTHER ACTION NEEDED; INCOMPLETE CLOSURE PROCESS FOR <br />THE LANDING SHOPPING CENTER; 3422 WEST HAMMER LANE, <br />STOCKTON, SAN JOAQUIN COUNTY <br /> <br /> <br />Central Valley Regional Water Quality Control Board (Central Valley Water Board) staff <br />have reviewed our files associated with the Landing Shopping Center (Site) and found <br />that additional action is needed for closure. You and/or your consultant received a <br />conditional closure letter, dated 5 January 2015, and subsequent letters were sent on <br />27 August 2020 and 4 February 2022, requesting an update. To complete the closure <br />process, you are required to destroy all wells and borings in accordance with local <br />regulations and requirements, remove all associated waste (e.g. drums, debris, <br />and other related materials), and submit a well destruction report no later than 8 <br />November 2024. <br /> <br />Our intent is to work cooperatively with Responsible Parties to expedite the closure <br />process; however, if the above-requested documentation is not received 8 November <br />2024 the next step will be to recommend formal enforcement actions to Central Valley <br />Water Board management. Such enforcement actions may include the issuance of a <br />Monitoring and Reporting Program (MRP) in accordance with California Water Code <br />section 13267. This MRP will establish deadlines for collecting groundwater monitoring <br />data and submitting routine reports to the Central Valley Water Board and will remain <br />effective until the Central Valley Water Board grants formal closure of the Site’s <br />environmental case or until the MRP is rescinded by the Executive Officer of the Central <br />Valley Water Board. Failure to comply with the requirements of an MRP may also <br />subject you to imposition of administrative civil liability, not to exceed $1,000 for <br />each day in which the violation occurs. <br /> <br />In addition, the new Central Valley Regional Water Quality Control Board Case <br />Manager for Site is KhristinaRae Leyba.
