The Spill Prevention, Control, <br />and Countermeasure (SPCC) Plan failed to have the full approval of management at a level of authority to commit the <br />necessary resources to fully implement the Plan. <br />REGULATION GUIDANCE: If you are the owner or operator of a facility subject to this part you must prepare a Plan in <br />accordance with good engineering practices. The Plan must have the full approval of management at a level of <br />authority to commit the necessary resources to fully implement the Plan. You must prepare the Plan in writing . If you <br />do not follow the sequence specified in this section for the Plan, you must prepare an equivalent Plan acceptable to <br />the Regional Administrator that meets all of the applicable requirements listed in this part , and you must supplement it <br />with a section cross-referencing the location of requirements listed in this part and the equivalent requirements in the <br />other prevention plan. If the Plan calls for additional facilities or procedures, methods, or equipment not yet fully <br />operational, you must discuss these items in separate paragraphs and must explain separately the details of <br />installation and operational start-up. <br />CORRECTIVE ACTION: Immediately obtain required management approval for the SPCC Plan for this facility. Provide <br />proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 11 <br />Code of Fed Regulations 112.7(f)(1) 4020001 - Training provided for op/maint of equip, discharge procedures, <br />laws/regs, general fac ops, and SPCC. <br />OBSERVATION: It appears that the oil handling personnel were not adequately trained, as required. Per the SPCC <br />Plan, SPCC Plan training is recorded on Appendix 8 of the SPCC Plan. No completed copies of the training found in <br />Appendix 8 were observed on site. <br />REGULATION GUIDANCE: (f)(1) At a minimum, train your oil-handling personnel in the operation and maintenance of <br />equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br />regulations; general facility operations; and, the contents of the facility SPCC Plan. <br />CORRECTIVE ACTION: Immediately provide adequate training to all oil handling personnel and submit a copy of the <br />training log and training content to the EHD. <br />This is (Class 2) Violation. <br /> 30 <br />Code of Fed Regulations 112.20(e) 4010044 - Substantial Harm Criteria certification maintained at the facility as <br />required. <br />OBSERVATION: The facility failed to complete and maintain (at the facility) the Substantial Harm Criteria certification <br />form, and the owner/or operator determined that the facility could not be reasonably expected to cause substantial <br />harm to the environment.
