(2) For the purpose of this subdivision, “substantial change” means any change in <br />a facility that would inhibit immediate response during an emergency by either site personnel or emergency response <br />personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational <br />knowledge of the facility, or impede implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br />CA Health and Safety Code 25508(a)(1) 1010003 - Business Owner/Operator ID and Business Activities pages <br />electronically submitted and are accurate. <br />OBSERVATION: The Business Owner Identification form was not updated when the newest owner took over the <br />business last year. <br />REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a repeat violation (Class 2) Violation. <br /> 9 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response(ER) procedures were lacking. <br />- Section C and E4 was not complete <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release <br />or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of <br />local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a <br />release or threatened release to minimize any potential harm or damage to persons, property, or the environment - <br />evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is a repeat violation (Class 2) Violation. <br /> 12 <br />CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br />for a minimum of three years. <br />OBSERVATION: At time of inspection, training records were not available. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training.
