Immediately conduct all necessary testing of all liquid level sensing devices to ensure proper operation, submit test results to the EHD. This is a repeat violation (Class 2) Violation. Code of Fed Regulations 112.8(d)(1) 4030027 - Buried piping is corrosion protected with protective wrapping, coating, or cathodic protection. OBSERVATION: The SPCC Plan failed to discuss buried piping with protective wrapping or coating, and to ensure it is cathodically protected or otherwise satisfies corrosion protection standards for piping. REGULATION GUIDANCE: (d)(1) Provide buried piping that is installed or replaced on or after August 16, 2002, with protective wrapping and coating. You must also cathodically protect such buried piping installations or otherwise satisfy the corrosion protection standards for piping in part 280 of this chapter or a State program approved under part 281 of this chapter. If a section of the buried line is exposed for any reason, you must carefully inspect it for deterioration. If you find corrosion damage, you must undertake additional examination and corrective action, as indicated by the magnitude of the damage. CORRECTIVE ACTION: Immediately provide the buried piping installed or replaced on or after August 16, 2002, with a protective wrapping and coating and cathodic protection. Provide proof of correction to the EHD. This is a repeat violation (Class 2) Violation. 66 CA Health and Safety Code 25270.6(a) 4010032 - Tank Facility Statement or Business Plan has been submitted . OBSERVATION: A complete tank facility statement or a business plan has not been submitted . REGULATION GUIDANCE: (a)(1) On or before January 1, annually, each owner or operator of a tank facility subject to this chapter shall file with the statewide information management system, a tank facility statement that shall identify the name and address of the tank facility, a contact person for the tank facility, the total storage capacity of the tank facility, and the location and contents of each petroleum storage tank that exceeds 10,000 gallons in storage capacity. A copy of a statement submitted previously pursuant to this section may be submitted in lieu of a new tank facility statement if no new or used storage tanks have been added to the facility or if no significant modifications have been made. For purposes of this section, a significant modification includes, but is not limited to, altering existing storage tanks or changing spill prevention or containment methods. (2) Notwithstanding paragraph (1), an owner or operator of a tank facility that submits a business plan, as defined in subdivision (d) of Section 25501 , to the statewide information management system and that complies with Sections 25503 , 25505 , 25505.1 , 25507 , 25507.2 , 25508 , 25508.1 , and 25508.2 , satisfies the requirement in paragraph (1) to file a tank facility statement. CORRECTIVE ACTION: This was corrected on site. A CERS submittal was made during the inspection today referencing the HMBP in lieu of submitting a Tank Facility Statement . This is (Class 2) Violation. 74 Code of Fed Regulations 112.20(e) 4010044 - Substantial Harm Criteria certification maintained at the facility as required.
