The business plan was last submitted on <br />12/13/2023, on time for the 2024 reporting year. The business plan was submitted late in 2022, and was not received <br />for 2020 and 2021. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year <br />and may be submitted beginning November 1 of the previous year <br />CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. The facility has since resubmitted CERS annually by the due date for 2023 <br />and 2024 reporting years, and the facility owner verbally agreed that the HMBP will be annually certified /submitted to <br />CERS on time going forward. This is corrected on site. <br />This is (Minor) Violation. <br /> 4 <br />CA Health and Safety Code 25508(a)(1) 1010003 - Business Owner/Operator ID and Business Activities pages <br />electronically submitted and are accurate. <br />OBSERVATION: The Business Owner/Operator Identification form was not submitted or complete. Secondary <br />emergency contact is left blank. On the emergency response / contingency plan, Rick Staples is listed as the <br />alternative emergency contact. <br />REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a repeat violation (Class 2) Violation. <br /> 9 <br />Overall Inspection Comments: <br />An inspection checklist was provided to the facility operator on the day of inspection.
