Environmental Health Department
Aboveground Petroleum Storage Act Inspection Report
Date:
May 13, 2024
Facility Address:
13401 S Union RD, MANTECA
Facility Name:
EDWARD CARDOZA
SUMMARY OF VIOLATIONS
(CLASS I, CLASS II, or MINOR - Notice to Comply)
RemarksItem #
108 HSC 25270.4.5(b) Failure of conditionally exempt facility to conduct inspections or install secondary containment.
OBSERVATION: The facility failed to allow the EHD to keep records of daily visual inspections to protect the waters
of the state. Per discussion with Edward Cardoza Jr, records of daily visual inspections are not kept.
REGULATION GUIDANCE: (b) A tank facility located on and operated by a farm, nursery, logging site, or
construction site is not subject to subdivision (a) if no storage tank at the location exceeds 20,000 gallons and the
cumulative storage capacity of the tank facility does not exceed 100,000 gallons. Unless excluded from the
definition of an “aboveground storage tank” in Section 25270.2, the owner or operator of a tank facility exempt
pursuant to this subdivision shall take the following actions:
(1) Conduct a daily visual inspection of any storage tank storing petroleum. For purposes of this section, “daily”
means every day that contents are added to or withdrawn from the tank, but no less than five days per week. The
number of days may be reduced by the number of state or federal holidays that occur during the week if there is no
addition to, or withdrawal from, the tank on the holiday. The UPA may reduce the frequency of inspections to not
less than once every three days at a tank facility that is exempt pursuant to this section if the tank facility is not
staffed on a regular basis, provided that the inspection is performed every day the facility is staffed.
(2) Allow the UPA to conduct a periodic inspection of the tank facility.
(3) If the UPA determines installation of secondary containment is necessary for the protection of the waters of the
state, install a secondary means of containment for each tank or group of tanks where the secondary containment
will, at a minimum, contain the entire contents of the largest tank protected by the secondary containment plus
precipitation.
CORRECTIVE ACTION: Conduct daily visual inspections to protect the waters of the state and keep records of
inspections.
This is a minor violation.
Overall Inspection Comments:
Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement
documenting the corrective actions that have been or will be taken for each violation, and any supporting
paperwork, by 6/12/2024.
To minimize person to person contact EHD is choosing to write the name of person receiving the report instead
of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at the EHD hourly
rate ($162). To schedule an appointment, please call (209) 468-3420.
The following was observed during this inspection: 10,000-Gallon Diesel Tank
AFTER THE COMPLIANCE DATE, EHD WILL BILL FOR ALL TIME AND ACTIVITIES ASSOCIATED WITH BRINGING
THIS FACILITY BACK INTO COMPLIANCE.
THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE.
Received by: Inspector Phone:
MATTHEW WON, EH Specialist
Inspector: Date:
Printed Name and Title:
,
(209) 616-3029
FA0016754 PR0539051 SC001 05/13/2024
EHD 28-01 Rev. 12/06/2021 Aboveground Petroleum Storage Act OIRPage 6 of 6
1868 E.
