Environmental Health Department <br />AMENDED <br />12/9/2024 <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />December 03, 2024 <br /> Facility Address: <br /> 1905 S MCHENRY AVE, ESCALON <br /> Facility Name: <br /> ESCALON PREMIER BRANDS <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />Code of Fed Regulations 112.7(a)(3)(v) 4010043 - SPCC Plan addresses disposal methods for recovered materials. <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan failed to address disposal methods <br />for recovered materials. <br />- Section 2A discusses that used oil is handled , stored and disposed of as CA hazardous waste but does not discuss <br />any potential diesel containing waste (should any diesel release). <br />- Various areas in the plan states that any spills can be easily cleaned up and the training section 6 states part of <br />training is disposal of clean-up materials but the plan does not discuss how spills are cleaned or where materials used <br />from the clean up are stored. Section 8B lists two clean up contractors familiar with Escalon Premier Brands but the <br />plan does not clarify if clean up contractors are the only ones conducting cleaning of spills or when clean up <br />contractors are contacted for spill clean up. <br />- Section 8b referenced the copy of the Oil Spill Response Plan is in Appendix F . Appendix F is Substantial Harm <br />Criteria. The Oil Spill Response Plan is in Appendix G but does not have any pages behind for that appendix besides a <br />blank page titles Oil Spill Response Plan. <br />REGULATION GUIDANCE: The SPCC plan shall include: 112.7(a)(3)(v) Methods of disposal of recovered materials in <br />accordance with applicable legal requirements; <br />CORRECTIVE ACTION: Ensure that the SPCC plan addresses disposal for recovered materials in accordance with <br />applicable legal requirements, submit proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 19 <br />Code of Fed Regulations 112.7(a)(3vi), 112.7(a4) 4010017 - SPCC contains procedures for reporting a discharge. <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan does not adequately discuss <br />procedures for reporting a discharge. <br />- Appendix C lists two incorrect phone numbers for San Joaquin County Environmental Health (EHD) in the first table <br />on page 19 and the Agency Notification Log on page 22. The correct phone number is 209-468-3420 for during office <br />hours and after office hours . <br />- One contact list containing numbers for facility response coordinator, National Response Center, clean up <br />contractor, Office of Emergency Services , EHD and any other appropriate Federal and State Agencies was not found . <br />The facility response coordinator contact information is listed in section 2D. Clean up contactor contact information is <br />listed in section 8B. No reference to the sections 2D and 8B was found in Section C. <br />- The Oil Spill History Form in Appendix C is missing : type of material, estimate of quantity, affected media, damages, <br />injuries, action taken to stop discharge. <br />REGULATION GUIDANCE: The SPCC plan shall include: 112.7(a)(3)(vi) Contact list and phone numbers for the facility <br />response coordinator, National Response Center, cleanup contractors with whom you have an agreement for <br />response, and all appropriate Federal, State, and local agencies who must be contacted in case of a discharge as <br />described in § 112.1(b). 112.7(a)(4) procedures to relay information on specifics listed in this section. <br /> 20 <br />FA0004254 PR0523373 SC001 12/03/2024 <br />EHD Rev. 12/06/2021 CP22 - AST Non-Qualified OIRPage 6 of 10 <br />1868 E.
