The business plan was last submitted on <br />01/10/2024. The business plan was not submitted in 2021 and was submitted late, 03/14/2022 for the 2022 reporting <br />year. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year <br />and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: The facility has since completed CERS business plan submittals within the reporting period, <br />on time. This was corrected on site. <br />This is (Minor) Violation. <br /> 4 <br />CA Health and Safety Code 25508.1(a)-(f) 1010006 - Updated within 30 days of 100% increase or new haz; change of <br />address/owner/name; or change in ops. <br />OBSERVATION: During the inspection, Greg Costa stated that the hazardous material inventory and the site map <br />contained outdated elements since at least 2 months ago and in some instances up to some time in 2023. The <br />business has not updated and submitted the information within 30 days. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br />a) A 100 percent or more increase in the quantity of a previously disclosed material. <br />b) Any handling of a previously undisclosed hazardous materials <br />c) A change of business or facility address <br />d) Change business ownership <br />e) Change of business name <br />f)(1) A substantial change in the handler 's operations occurs that requires modification to any portion of the business <br />plan. <br />(2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede <br />implementation of the business plan. <br /> 5 <br />FA0010220 PR0520153 SC001 12/10/2024 <br />EHD Rev. 12/06/2021 CP22 - HMBP OIRPage 2 of 3 <br />1868 E.
