OBSERVATION: The facility failed to prepare an SPCC Plan that meets all applicable requirements. - The SPCC plan fails to follow an accurate cross reference - The facility diagram does not show the location of all Bulk oil containers that are mentioned in the SPCC plan, the 55-gallon drums are not indicated in the diagram. REGULATION GUIDANCE: 25270.4.5 (a) Except as provided in subdivision (b), the owner or operator of a storage tank at a tank facility subject to this chapter shall prepare a spill prevention control and countermeasure plan applying good engineering practices to prevent petroleum releases using the same format required by Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations, including owners and operators of tank facilities not subject to the general provisions in Section 112.1 of those regulations. An owner or operator specified in this subdivision shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator specified in this subdivision shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan in accordance with § 112.7 and any other applicable section of this part. CORRECTIVE ACTION: Ensure that facility's SPCC plan meets all applicable requirements. Submit proof of correction to the EHD This is (Minor) Violation. 2 Code of Fed Regulations 112.3 4030038 - SPCC has been implemented. OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as required. Section 5.2.8 of SPCC plan mentions that the overfill prevention system must be tested monthly and yearly. Despite this, the inspection checklist that is completed monthly and yearly only has 2 questions addressing overfill and on multiple inspections the inspector responds with "N/A". Additionally, Patrick Glover was asked how the overfill prevention system is tested according to this section and an answer could not be provided. Section 4.5a of SPCC plan says Appendix I contains the discharge response equipment inventory but it was found in Appendix A. It is also mentioned in this section that the inventory will be inspected monthly but in Appendix A the last inspection was done on 5/23/23. Lastly, the remaining inventory inspections were later found to be located with the monthly aboveground inspections.
