An owner or <br />operator specified in this subdivision shall conduct periodic inspections of the storage tank to ensure compliance with <br />Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. <br />In implementing the spill prevention control and countermeasure plan, an owner or operator specified in this subdivision <br />shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of <br />Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. 112.3: The owner or operator or an onshore <br />or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and <br />Countermeasure Plan in accordance with § 112.7 and any other applicable section of this part. <br />CORRECTIVE ACTION: Ensure that facility's SPCC plan meets all applicable requirements. Submit proof of correction <br />to the EHD <br />This is (Minor) Violation. <br /> 2 <br />Code of Fed Regulations 112.3 4030038 - SPCC has been implemented. <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as required. <br />Section 5.2.8 of SPCC plan mentions that the overfill prevention system must be tested monthly and yearly. Despite <br />this, the inspection checklist that is completed monthly and yearly only has 2 questions addressing overfill and on <br />multiple inspections the inspector responds with "N/A". Additionally, Patrick Glover was asked how the overfill <br />prevention system is tested according to this section and an answer could not be provided. <br />Section 4.5a of SPCC plan says Appendix I contains the discharge response equipment inventory but it was found in <br />Appendix A. It is also mentioned in this section that the inventory will be inspected monthly but in Appendix A the last <br />inspection was done on 5/23/23.
