Environmental Health Department <br />AMENDED <br />1/28/2025 <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />January 17, 2025 <br /> Facility Address: <br /> 19400 N HWY 99 , ACAMPO <br /> Facility Name: <br /> J S G TRUCKING COMPANY <br /> □ OUT □ R □ COS4045 - Release/Leaks/Spills - General Local Ordinance 86 <br /> □ OUT □ R □ COS4050 - Abandonment/Illegal Disposal/Unauthorized Treatment - General See below 87 <br /> □ OUT □ R □ COS4055 - Abandonment/Illegal Disposal/Unauthorized Treatment - General Local Ordinance 88 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />Code of Fed Regulations 112.3 4030038 - SPCC has been implemented. <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as required. <br />Items were required by the SPCC Plan and were not implemented as follows: <br />1) Sections 3.9-3.10/4.4: Conduct monthly and annual inspections using the forms included in this plan. No annual <br />inspection was found for 2024 and the last monthly inspection was dated January 2023. Derek informed that <br />inspections are conducted informally daily, not documented. <br />2) Sections 3.5/5.0/5.5/Appendix I: Spill response equipment inventory for the facility should be kept and replenished <br />as described in the plan. No spill response equipment was kept near the diesel AST . Other spill equipment was not <br />found as indicated in Appendix I . Derek stated to his knowledge, he has not seen spill response equipment kept at the <br />diesel AST. <br />REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must <br />prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or <br />“Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall <br />conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) <br />of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control <br />and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in <br />Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. <br />CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. <br />This is (Class 2) Violation. <br /> 3 <br />Code of Fed Regulations 112.5(b) 4010009 - 5 year review performed on SPCC and documented. <br />OBSERVATION: The facility failed to perform the 5-year review of the SPCC plan. The Spill Prevention, Control, and <br />Countermeasure (SPCC) Plan was last reviewed on October 29, 2019. <br />REGULATION GUIDANCE: (b) Notwithstanding compliance with paragraph [112.5] (a) of this section, complete a <br />review and evaluation of the SPCC Plan at least once every five years from the date your facility becomes subject to <br />this part; or, if your facility was in operation on or before August 16, 2002, five years from the date your last review was <br />required under this part. As a result of this review and evaluation, you must amend your SPCC Plan within six months <br />of the review to include more effective prevention and control technology if the technology has been field -proven at the <br />time of the review and will significantly reduce the likelihood of a discharge as described in § 112.1(b) from the facility. <br />You must implement any amendment as soon as possible , but not later than six months following preparation of any <br />amendment. You must document your completion of the review and evaluation , and must sign a statement as to <br />whether you will amend the Plan, either at the beginning or end of the Plan or in a log or an appendix to the Plan. The <br />following words will suffice, “I have completed review and evaluation of the SPCC Plan for (name of facility) on (date), <br />and will (will not) amend the Plan as a result.” <br />CORRECTIVE ACTION: Immediately complete and document the 5-year review of the SPCC Plan and make any <br />necessary amendments (a Professional Engineer must certify any technical amendments).
