OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as required. Items were required by the SPCC Plan and were not implemented as follows: 1) Sections 3.9-3.10/4.4: Conduct monthly and annual inspections using the forms included in this plan. No annual inspection was found for 2024 and the last monthly inspection was dated January 2023. Derek informed that inspections are conducted informally daily, not documented. 2) Sections 3.5/5.0/5.5/Appendix I: Spill response equipment inventory for the facility should be kept and replenished as described in the plan. No spill response equipment was kept near the diesel AST . Other spill equipment was not found as indicated in Appendix I . Derek stated to his knowledge, he has not seen spill response equipment kept at the diesel AST. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or “Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is (Class 2) Violation. 3 Code of Fed Regulations 112.5(b) 4010009 - 5 year review performed on SPCC and documented. OBSERVATION: The facility failed to perform the 5-year review of the SPCC plan. The Spill Prevention, Control, and Countermeasure (SPCC) Plan was last reviewed on October 29, 2019. REGULATION GUIDANCE: (b) Notwithstanding compliance with paragraph [112.5] (a) of this section, complete a review and evaluation of the SPCC Plan at least once every five years from the date your facility becomes subject to this part; or, if your facility was in operation on or before August 16, 2002, five years from the date your last review was required under this part. As a result of this review and evaluation, you must amend your SPCC Plan within six months of the review to include more effective prevention and control technology if the technology has been field -proven at the time of the review and will significantly reduce the likelihood of a discharge as described in § 112.1(b) from the facility. You must implement any amendment as soon as possible , but not later than six months following preparation of any amendment. You must document your completion of the review and evaluation , and must sign a statement as to whether you will amend the Plan, either at the beginning or end of the Plan or in a log or an appendix to the Plan. The following words will suffice, “I have completed review and evaluation of the SPCC Plan for (name of facility) on (date), and will (will not) amend the Plan as a result.” CORRECTIVE ACTION: Immediately complete and document the 5-year review of the SPCC Plan and make any necessary amendments (a Professional Engineer must certify any technical amendments).
