The contents of the SPCC Plan. <br />REGULATION GUIDANCE: (f)(1) At a minimum, train your oil-handling personnel in the operation and maintenance of <br />equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br />regulations; general facility operations; and, the contents of the facility SPCC Plan. <br />CORRECTIVE ACTION: Immediately provide adequate training to all oil handling personnel and submit a copy of the <br />training log and training content to the EHD. <br />This is (Class 2) Violation. <br />Code of Fed Regulations 112.7(f)(2) 4010022 - Person has been designated as accountable for discharge prevention <br />and reports to management. <br />OBSERVATION: The facility designated person for discharge prevention is no longer working for the company and this <br />information is incorrect. Section 1.2 references Appendix H for the designated person and /or responsible individuals. <br />Appendix H references Pete Cameron, Vice President; and Joe Giammona, President; as the primary and secondary <br />persons responsible respectively. These positions are now filled by Derek Crusenberry and Rachel Crusenberry, <br />respectively. <br />REGULATION GUIDANCE: (f)(2) Designate a person at each applicable facility who is accountable for discharge <br />prevention and who reports to facility management. <br />CORRECTIVE ACTION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan shall designate a person at <br />the facility who is accountable for discharge prevention and who reports to facility management. Designate a person <br />accountable for discharge prevention, submit proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 31 <br />Code of Fed Regulations 112.7(e), 112.8(c)(6) 4030014 - Tanks inspected and tested by qualified person in accordance <br />with industry standards. <br />OBSERVATION: Facility failed to ensure that tanks are inspected and tested by an appropriately qualified person in <br />accordance with industry standards. The Diesel, used oil, and motor oil tanks were not inspected or tested on <br />schedule per the SPCC Plan. The last record of Monthly Inspections were in January 2023. Derek stated that daily <br />inspections are done in lieu of the monthly inspections, however there is no documentation of these inspections. An <br />annual inspection was not conducted in 2024. <br />REGULATION GUIDANCE: 112.8(c)(6) Test or inspect each aboveground container for integrity on a regular schedule <br />and whenever you make material repairs. <br />CORRECTIVE ACTION: Immediately ensure that all tanks are inspected and tested by an appropriately qualified <br />person in accordance with industry standards.
