Environmental Health Department <br />AMENDED <br />1/15/2025 <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />September 25, 2024 <br /> Facility Address: <br /> 7707 Austin RD, Stockton <br /> Facility Name: <br /> CDCR-California Health Care Facility <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />REGULATION GUIDANCE: (a)(1) On or before January 1, annually, each owner or operator of a tank facility subject to <br />this chapter shall file with the statewide information management system, a tank facility statement that shall identify <br />the name and address of the tank facility, a contact person for the tank facility, the total storage capacity of the tank <br />facility, and the location and contents of each petroleum storage tank that exceeds 10,000 gallons in storage <br />capacity. A copy of a statement submitted previously pursuant to this section may be submitted in lieu of a new tank <br />facility statement if no new or used storage tanks have been added to the facility or if no significant modifications have <br />been made. For purposes of this section, a significant modification includes, but is not limited to, altering existing <br />storage tanks or changing spill prevention or containment methods. (2) Notwithstanding paragraph (1), an owner or <br />operator of a tank facility that submits a business plan, as defined in subdivision (d) of Section 25501 , to the <br />statewide information management system and that complies with Sections 25503 , 25505 , 25505.1 , 25507 , <br />25507.2 , 25508 , 25508.1 , and 25508.2 , satisfies the requirement in paragraph (1) to file a tank facility statement. <br />CORRECTIVE ACTION: Immediately submit a complete and adequate tank facility statement or a business plan. <br />Also include the correct amount of petroleum products. Submit proof of correction to the EHD. <br />This is (Class 2) Violation. <br />Code of Fed Regulations 112.20(e) 4010044 - Substantial Harm Criteria certification maintained at the facility as <br />required. <br />OBSERVATION: The facility failed to complete and maintain (at the facility) the Substantial Harm Criteria certification <br />form, and Associate Hazardous Materials Specialist Anthony Vanni determined that the facility could not be <br />reasonably expected to cause substantial harm to the environment. The Substantial Harm Criteria certification form <br />was not signed in the plan. <br />REGULATION GUIDANCE: (e) If the owner or operator of a facility determines pursuant to paragraph (a)(2) of this <br />section that the facility could not, because of its location, reasonably be expected to cause substantial harm to the <br />environment by discharging oil into or on the navigable waters or adjoining shorelines, the owner or operator shall <br />complete and maintain at the facility the certification form contained in appendix C to this part and, in the event an <br />alternative formula that is comparable to one contained in appendix C to this part is used to evaluate the criterion in <br />paragraph (f)(1)(ii)(B) or (f)(1)(ii)(C) of this section, the owner or operator shall attach documentation to the certification <br />form that demonstrates the reliability and analytical soundness of the comparable formula and shall notify the Regional <br />Administrator in writing that an alternative formula was used. <br />CORRECTIVE ACTION: Complete and maintain at the facility the Substantial Harm Criteria certification form. Submit <br />proof of correction to the EHD. <br />This is (Class 2) Violation. <br /> 78 <br />Overall Inspection Comments: <br />An inspection checklist was provided to the facility operator. A document request was sent to the facility . The <br />SPCC plan and submitted documents were reviewed and the final inspection report was completed on December <br />19, 2024. <br />The report was amended on January 15, 2025 to include violation 4010032.
