Section 5.3 did not address 40 CFR 112, 112.8(d)(4). <br />The following 40 CFR 112 sections were not found discussed or found otherwise not meeting applicable requirements: <br />-112.8(c)(8) <br />-112.8(c)(8)(v) <br />-112.8(c)(11) <br />REGULATION GUIDANCE: 25270.4.5 (a) Except as provided in subdivision (b), the owner or operator of a storage tank <br />at a tank facility subject to this chapter shall prepare a spill prevention control and countermeasure plan applying good <br />engineering practices to prevent petroleum releases using the same format required by Part 112 (commencing with <br />Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations, including owners and <br />operators of tank facilities not subject to the general provisions in Section 112.1 of those regulations. In implementing <br />the spill prevention control and countermeasure plan, an owner or operator specified in this subdivision shall fully <br />comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of Subchapter <br />D of Chapter I of Title 40 of the Code of Federal Regulations. 112.3: The owner or operator or an onshore or offshore <br />facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure <br />Plan in accordance with § 112.7 and any other applicable section of this part. <br />CORRECTIVE ACTION: Ensure that facility's SPCC plan meets all applicable requirements. Submit proof of correction <br />to the EHD. <br />This is (Minor) Violation. <br /> 2 <br />Code of Fed Regulations 112.3(e)(1) 4010008 - SPCC onsite If facility staffed 4 hrs/day, or at the nearest field office if <br />not so attended. <br />OBSERVATION: A copy of the complete Spill Prevention , Control, and Countermeasure (SPCC) Plan was not <br />maintained onsite at the time of inspection. <br />REGULATION GUIDANCE: (e) If you are the owner or operator of a facility for which a Plan is required under this <br />section, you must: (1) Maintain a complete copy of the Plan at the facility if the facility is normally attended at least <br />four hours per day, or at the nearest field office if the facility is not so attended . <br />CORRECTIVE ACTION: A copy of this plan was printed out during the inspection .
