The inventory section was submitted late on <br />11-17-2022 for the year of 2022. This violation has been corrected. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. <br />This is (Class 2) Violation. <br />12 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response(ER) procedures were lacking or inadequate. The emergency response and <br />contingency plan is not uploaded. There are training records but no emergency response plan in this section. <br />Complete and upload a copy the emergency response and contingency plan into CERS. <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a <br />release or threatened release of hazardous materials, including, but not limited to, the following: - immediate <br />notification of local emergency personnel and the Environmental Health Department (EHD) - procedures for the <br />mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the <br />environment - evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation, <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There was 1 violation found during the <br />inspection.
