The business plan was submitted late on 2-28-2019 <br />for the year of 2019. The business plan was submitted late on 2/19/2020 for the year of 2020. The submitted on time <br />for the years of 2021 through 2024. This violation has been corrected. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement <br />to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. <br />This is a repeat violation (Class 2) Violation. <br />14 <br />CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br />for a minimum of three years. <br />OBSERVATION: Employee training records were unavailable for review. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or <br />threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and <br />procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the <br />unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential <br />harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate <br />notice, for the business site. This training shall be documented electronically or by hard copy and shall be made <br />available for a minimum of three years. CORRECTIVE ACTION: Immediately provide employee training for <br />appropriate personnel and submit a copy of the training records to the EHD. <br />This is (Class 2) Violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There was 2 violations found during the <br />inspection.
