OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was submitted late on 2-28-2019 for the year of 2019. The business plan was submitted late on 2/19/2020 for the year of 2020. The submitted on time for the years of 2021 through 2024. This violation has been corrected. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a repeat violation (Class 2) Violation. 14 CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records for a minimum of three years. OBSERVATION: Employee training records were unavailable for review. REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years. CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the training records to the EHD. This is (Class 2) Violation. Overall Inspection Comments: Conducted a Hazardous Materials Business Plan (HMBP) inspection. There was 2 violations found during the inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 9/22/2024.
