OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was submitted late on 4-20-2020 for the year of 2020. The plans section was not submitted for the year of 2020. The business plan was submitted late on 2-15-2023 for the year of 2023. The business plan was submitted late on 3-22-2024 for the year of 2024. This violation has been corrected. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is (Class 2) Violation. 12 CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for release/threatened release of hazmat. OBSERVATION: The emergency response(ER) procedures were not correct. The local Unified Program Agency (UPA) phone number of 209-468-3428 is not correct. The UPA phone number needs to be listed as 209-468-3420. REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment - evacuation plans and procedures, including immediate notice, for the site CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This is (Class 2) Violation. Overall Inspection Comments: Routine HMBP Inspection. Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 2 violation found during the inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 11/17/2024.
