OBSERVATION: 5,434 cubic feet of liquid oxygen were found on site that have not been reported to CERS. Add liquid oxygen to the chemical inventory in CERS and then make a new submittal. REGULATION GUIDANCE: Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval. This is (Minor) Violation. 14 CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records for a minimum of three years. OBSERVATION: Training records were unavailable for review at time of inspection. Provide completed employee training records to Nick Loehrer by email nloehrer@sjgov.org REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years. CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the training records to the EHD. This is a repeat violation (Class 2) Violation.
