OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was submitted late on 1/25/2024 for the year of 2024. This violation has been corrected. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is (Class 2) Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information electronically submitted. OBSERVATION: The Hazardous Materials Inventory forms for Helium and Carbon Dioxide R744, were not complete. The max daily amounts need to be updated. The max daily amount for carbon dioxide R744 in the external locker area is 2,040 pounds. The max daily amount for helium is 2,196 cubic feet. The propane is less than 55 gallons and is not required to on inventory. The max daily amount for the carbon dioxide R744 in the refrigeration system needs to be updated and listed in pounds. REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part of the business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. OBSERVATION: A site map was not completed and submitted as part of the business plan. The site map is incomplete. The evacuation staging are was not identified on the site map. Add the location of the evacuation staging area to the site map. REGULATION GUIDANCE: site map that contains north orientation, adjacent streets, access and exit points, evacuation staging areas, hazardous material handling and storage areas, emergency response equipment, and, if present, loading areas, internal roads, storm and sewer drains, and emergency shutoffs, as well as additional map requirements the governing body of the unified program agency finds necessary.
