OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date, January 15. The business did not make a submittal for the year of 2022. The business plan was submitted late on 1/22/2024 for the year of 2024. This violation has been corrected. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is (Class 2) Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information electronically submitted. OBSERVATION: The Hazardous Materials Inventory forms for carbon dioxide were not complete. The unit of measure and the max daily amount need to be updated. The unit of measure should be changed from cubic feet to pounds. The max daily amount needs to be changed from 500 to 1,100 pounds. REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part of the business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is (Minor) Violation. Overall Inspection Comments: Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 2 violation found during the inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 10/20/2024. To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign.
