OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was not submitted for the year of 2021. the business plan was submitted late on 5/25/2022 for the year of 2022. The business plan was submitted late on 2/17/2023 for the year of 2023. The business plan was submitted on time for the year of 2024. This violation has been corrected on site. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is (Class 2) Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information electronically submitted. OBSERVATION: The Hazardous Materials Inventory forms for the cooling water treatment chemicals were not complete. The max daily amounts are listed at 0.25 gallons, 0.25 gallons, and 2 gallons are not accurate. The max daily amount for CHEM -AQUA 42171 needs to be listed at 60 gallons. The max daily amount for CHECK -MARK 40224CM needs to be listed at 40 gallons. The max daily amount for CHEM -AQUA 31155 needs to be listed at 140 gallons. The hydraulic bailer may need to be on inventory if the tank contains more than 55 gallons of hydraulic fluid. REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part of the business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a repeat violation (Class 2) Violation. 12 CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for release/threatened release of hazmat. OBSERVATION: The emergency response(ER) procedures were lacking or inadequate. The emergency response procedures are missing the name and phone number of the nearest medical facility. The local Unified Program Agency (UPA) phone number was not provided. The local UPA phone number is 209-468-3420 needs to be provided in the emergency response and contingency plan.
