The business plan was not submitted for the year of <br />2021. the business plan was submitted late on 5/25/2022 for the year of 2022. The business plan was submitted late <br />on 2/17/2023 for the year of 2023. The business plan was submitted on time for the year of 2024. This violation has <br />been corrected on site. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement <br />to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. <br />This is (Class 2) Violation. <br />10 <br />CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information <br />electronically submitted. <br />OBSERVATION: The Hazardous Materials Inventory forms for the cooling water treatment chemicals were not <br />complete. The max daily amounts are listed at 0.25 gallons, 0.25 gallons, and 2 gallons are not accurate. The max <br />daily amount for CHEM -AQUA 42171 needs to be listed at 60 gallons. The max daily amount for CHECK -MARK <br />40224CM needs to be listed at 40 gallons. The max daily amount for CHEM -AQUA 31155 needs to be listed at 140 <br />gallons. The hydraulic bailer may need to be on inventory if the tank contains more than 55 gallons of hydraulic fluid. <br />REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part <br />of the business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System <br />(CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a repeat violation (Class 2) Violation. <br />12 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response(ER) procedures were lacking or inadequate. The emergency response <br />procedures are missing the name and phone number of the nearest medical facility. The local Unified Program Agency <br />(UPA) phone number was not provided.
