OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as required. Discharge Prevention Briefings were not implemented. Training records for the last three years were not available during inspection. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or “Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is (Class 2) Violation. 3 Code of Fed Regulations 112.5(a), 112.5(b) 4010010 - Facility has amended SPCC as necessary. OBSERVATION: The facility failed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan within six months of when there was a change in design, construction, operation, or maintenance, which affects the facility’s discharge potential. Observed section 3.2 of the SPCC plan internal notification table needed updating to include Adrian Taylor who has been their Environmental Contact for two years and remove Frank DeSousa , Fleet Supervisor - Secondary Emergency Contact who left the company more than six months ago. REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in § 112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge as described in § 112.1(b). CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents facility design, procedures, and policies currently in place. Provide proof of correction to the EHD. This is a repeat violation (Class 2) Violation. 7 Code of Fed Regulations 112.5(b) 4010009 - 5 year review performed on SPCC and documented. OBSERVATION: The facility failed to perform the 5-year review of the SPCC plan. The Spill Prevention, Control, and Countermeasure (SPCC) Plan was last reviewed on October 22, 2018. REGULATION GUIDANCE: (b) Notwithstanding compliance with paragraph [112.5] (a) of this section, complete a review and evaluation of the SPCC Plan at least once every five years from the date your facility becomes subject to this part; or, if your facility was in operation on or before August 16, 2002, five years from the date your last review was required under this part.
