Conduct all required spill <br />prevention briefings. Provide compliance verification to the EHD. <br />This is (Minor) Violation. <br />Code of Fed Regulations 112.8(c)(2) 4030010 - Adequately sized secondary containment provided and maintained for <br />bulk storage containers. <br />OBSERVATION: The facility failed to provide and maintain secondary containment for bulk storage tank installations <br />sufficient to hold the capacity of the largest container , including adequate freeboard for precipitation. The secondary <br />containment, under the covered area, to the far left had an accumulation of dark liquid. <br />REGULATION GUIDANCE: (c)(2)Construct all bulk storage tank installations (except mobile refuelers and other <br />non-transportation-related tank trucks) so that you provide a secondary means of containment for the entire capacity <br />of the largest single container and sufficient freeboard to contain precipitation . You must ensure that diked areas are <br />sufficiently impervious to contain discharged oil . Dikes, containment curbs, and pits are commonly employed for this <br />purpose. You may also use an alternative system consisting of a drainage trench enclosure that must be arranged so <br />that any discharge will terminate and be safely confined in a facility catchment basin or holding pond. <br />CORRECTIVE ACTION: Immediately provide and maintain adequate secondary containment for the following bulk <br />storage tanks. Submit proof of correction to the EHD. <br />This is (Class 2) Violation. <br /> 48 <br />CA Health and Safety Code 25404(e)(4) 4010 - Administration/Documentation - General. <br />OBSERVATION: A submission to the California Environmental Reporting System (CERS) for the Aboveground <br />Petroleum Storage Act (APSA) program has not been made for 2025. <br />REGULATION GUIDANCE: 25404(e)(4) No later than three years after the statewide information management system <br />is established, each CUPA, PA, and regulated business shall report program data electronically. The secretary shall <br />work with the CUPAs to develop a phase -in schedule for the electronic collection and submittal of information to be <br />included in the statewide information management system, giving first priority to information relating to those <br />chemicals determined by the secretary to be of greatest concern. The secretary, in making this determination shall <br />consult with the CUPAs, the California Emergency Management Agency , the State Fire Marshal, and the boards, <br />departments, and offices within the California Environmental Protection Agency . <br />CORRECTIVE ACTION: Beginning January 1, 2013, all businesses are required to submit all new (or any changes to <br />existing) Aboveground Petroleum Storage Act (APSA) information online to the CERS at http://cers.calepa.ca.gov. Be <br />sure to include your APSA activity in the Businesses Activities section in CERS in addition to any other relevant <br />activities and required fields.
