CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This is a repeat violation (Class 2) Violation. CA Health and Safety Code 25505(a)(4) 1020001 - Established and electronically submitted adequate training program. OBSERVATION: A training program was lacking or insufficient . Manager Marinna Kel stated she had not received hazardous material training since starting with the company more than 30 days ago. An additional team member demonstrated knowledge of the dangers of CO2 but stated that his knowledge came from external sources and he had not received training from Jack in the Box on this topic. REGULATION GUIDANCE: Training programs for all employees and annual training , including refresher courses, shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or threatened release of a hazardous material. Training shall cover, but not limited to, all of the following: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site. These training programs may take into consideration the position of each employee. CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This is (Minor) Violation. 13 CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records for a minimum of three years. OBSERVATION: No training records were observed on site and employees present stated they had not received hazardous material training from Jack in the Box. REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site.
