Environmental Health Department <br />CP22 - HMBP Inspection Report <br />Date: <br />October 31, 2024 <br /> Facility Address: <br /> 2439 W MARCH LN, STOCKTON <br /> Facility Name: <br /> WENDYS (MARCH LANE) <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />b) Any handling of a previously undisclosed hazardous materials <br />c) A change of business or facility address <br />d) Change business ownership <br />e) Change of business name <br />f)(1) A substantial change in the handler 's operations occurs that requires modification to any portion of the business <br />plan. (2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede <br />implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is (Minor) Violation. <br />CA Health and Safety Code 25505(a)(2) 1010005 - Site Map with all required content electronically submitted. <br />OBSERVATION: The site map is incomplete. <br />-Missing adjacent street labels <br />-Missing CO2 loading zone label <br />REGULATION GUIDANCE: site map that contains north orientation, adjacent streets, access and exit points, <br />evacuation staging areas, hazardous material handling and storage areas, emergency response equipment, and, if <br />present, loading areas, internal roads, storm and sewer drains, and emergency shutoffs , as well as additional map <br />requirements the governing body of the unified program agency finds necessary. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is (Minor) Violation. <br /> 11 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response(ER) procedures were lacking or inadequate. <br />-Plan is not signed <br />-Emergency Assembly Area (E3) is blank <br />-Arrangements for Emergency Services (F1) is blank <br />-Employee Training (I1-I3) is blank <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release <br />or threatened release of hazardous materials, including, but not limited to, the following: <br />-Immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br />-Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br />-Evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br /> 12 <br />FA0001553 PR0520751 SC001 10/31/2024 <br />EHD Rev. 12/06/2021 CP22 - HMBP OIRPage 3 of 5 <br />1868 E.
