Environmental Health Department <br />CP22 - HMBP Inspection Report <br />Date: <br />December 12, 2024 <br /> Facility Address: <br /> 28 E GRANT LINE RD, TRACY <br /> Facility Name: <br /> FOSTERS OLD FASHION FREEZE <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />This is (Class 2) Violation. <br />CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information <br />electronically submitted. <br />OBSERVATION: An about 450 pound (3,900 cubic feet) CO2 tank was found on site that has not been reported to <br />CERS. <br />REGULATION GUIDANCE: Any material that meets or exceeds the reportable quantity shall be reported in the <br />facility's business plan. <br />CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br /> 10 <br />CA Health and Safety Code 25505(a)(2) 1010005 - Site Map with all required content electronically submitted. <br />OBSERVATION: A site map was not completed and submitted as part of the business plan . <br />REGULATION GUIDANCE: site map that contains north orientation, adjacent streets, access and exit points, <br />evacuation staging areas, hazardous material handling and storage areas, emergency response equipment, and, if <br />present, loading areas, internal roads, storm and sewer drains, and emergency shutoffs , as well as additional map <br />requirements the governing body of the unified program agency finds necessary. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br /> 11 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response(ER) plan has not been submitted to CERS. <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release <br />or threatened release of hazardous materials, including, but not limited to, the following: <br />- immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br />- procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br />- evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br /> 12 <br />CA Health and Safety Code 25505(a)(4) 1020001 - Established and electronically submitted adequate training <br />program. <br />OBSERVATION: A training program was lacking or insufficient . <br /> 13 <br />FA0003108 PR0547385 SC001 12/12/2024 <br />EHD Rev. 12/06/2021 CP22 - HMBP OIRPage 3 of 5 <br />1868 E.
