The audible <br />alarms are tested monthly but the high liquid level alarm (probe) inside the the tanks have not been tested for <br />functionality. <br />REGULATION GUIDANCE: 112.8(c)(8)(v) You must regularly test liquid level sensing devices to ensure proper <br />operation. <br />CORRECTIVE ACTION: Liquid level sensing devices must be installed in accordance with CFR 112.8 and shall be <br />regularly tested to ensure proper operation. Immediately conduct all necessary testing of the high liquid level sensing <br />devices on both diesel tanks to ensure proper operation, submit test results to the EHD. <br />This is (Class 2) Violation. <br /> 61 <br />CA Health and Safety Code 25270.6(a) 4010032 - Tank Facility Statement or Business Plan has been submitted . <br />OBSERVATION: A complete tank facility statement or a business plan has not been submitted on time by January 1, <br />2025 or hazardous materials business plan (HMBP) submittal by January 15, 2025. ASPA and HMBP submittals were <br />made late on 3/3/2025. <br />REGULATION GUIDANCE: 25270 (a)(1) On or before January 1, annually, each owner or operator of a tank facility <br />subject to this chapter shall file with the statewide information management system, a tank facility statement that <br />shall identify the name and address of the tank facility, a contact person for the tank facility, the total storage capacity <br />of the tank facility, and the location and contents of each petroleum storage tank that exceeds 10,000 gallons in <br />storage capacity. A copy of a statement submitted previously pursuant to this section may be submitted in lieu of a <br />new tank facility statement if no new or used storage tanks have been added to the facility or if no significant <br />modifications have been made. For purposes of this section, a significant modification includes, but is not limited to, <br />altering existing storage tanks or changing spill prevention or containment methods.(2) Notwithstanding paragraph (1), <br />an owner or operator of a tank facility that submits a business plan, as defined in subdivision (d) of Section 25501 , to <br />the statewide information management system and that complies with Sections 25503 , 25505 , 25505.1 , 25507 , <br />25507.2 , 25508 , 25508.1 , and 25508.2 , satisfies the requirement in paragraph (1) to file a tank facility statement. <br />CORRECTIVE ACTION: Ensure annual tank facility statements are submitted on time by January 1, 2025 or submit <br />on time with HMBP submittal January 15, 2025. <br />This is (Class 2) Violation. <br /> 74 <br />Overall Inspection Comments: <br />Routine APSA Inspection <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />FA0020706 PR0536585 SC001 04/21/2025 <br />EHD Rev. 12/06/2021 CP22 - AST Non-Qualified OIRPage 5 of 6 <br />1868 E.
