The 2022 CERS submittal was not submitted. The <br />2023 submittal was entered late. The 2024 CERS submittal was submitted on time however, it was not accepted due <br />to errors that needed to be fix. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year <br />and may be submitted beginning November 1 of the previous year <br />CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. <br />This is a repeat violation (Class 2) Violation. <br /> 4 <br />CA Health and Safety Code 25508.1(a)-(f) 1010006 - Updated within 30 days of 100% increase or new haz; change of <br />address/owner/name; or change in ops. <br />OBSERVATION: During the inspection, Hamid Ahmad stated that they had always had the used break oil , used <br />lubricating oil and used motor oil. The business has not updated and submitted the information within 30 days. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase <br />in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials c) <br />A change of business or facility address d ) Change business ownership e) Change of business name f)(1) A <br />substantial change in the handler's operations occurs that requires modification to any portion of the business plan. <br />(2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, <br />or impede implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is (Minor) Violation. <br /> 5 <br />FA0016114 PR0529912 SC001 12/11/2024 <br />EHD Rev. 12/06/2021 CP22 - HMBP OIRPage 2 of 5 <br />1868 E.
