The business plan was submitted late on 3/25/2024 <br />for the year of 2024.The business plan was not submitted for the years of 2020, 2021, 2022, 2023, and 2025. <br />Immediately make a new submittal in CERS for the year of 2025. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. <br />This is a repeat violation (Class 2) Violation. <br />10 <br />CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information <br />electronically submitted. <br />OBSERVATION: The Hazardous Materials Inventory forms for motor oil, ATF, antifreeze,and waste oil were not <br />complete. Obsolete federal hazard categories were found on chemical fact sheet for motor oil, ATF, antifreeze,and <br />waste oil. 110 gallons of used antifreeze was found on site and has not been added to the chemical inventory. Add <br />110 gallons of used antifreeze to the chemical inventory. <br />REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part of <br />the business plan. <br />CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is (Minor) Violation. <br />12 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response(ER) procedures were not complete. Doctors Hospital is listed as the <br />nearest medical facility but has no phone number listed in section C5 of the emergency response and contingency <br />plan.
