The SPCC Plan lists the <br />accountable person on page 12 as Cesar Nunez who is no longer with the company. <br />REGULATION GUIDANCE: 112.7(f)(2) Designate a person at each applicable facility who is accountable for discharge <br />prevention and who reports to facility management. <br />CORRECTIVE ACTION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan shall designate a person at <br />the facility who is accountable for discharge prevention and who reports to facility management. Designate a person <br />accountable for discharge prevention, submit proof of correction to the EHD. <br />This is (Class 2) Violation. <br /> 33 <br />Code of Fed Regulations 112.8(c)(8)(v) 4030022 - Liquid level sensing devices regularly tested to ensure proper <br />operation. <br />OBSERVATION: Liquid level sensing devices for the diesel tank have not been tested. SPCC Plan lists the overfill <br />prevention as "High liquid level pump cutoff device " but the plan also marked "N/A" for Liquid sensing devices are <br />regularly tested to ensure proper operation. <br />REGULATION GUIDANCE: 112.8 (c)(8)(v) You must regularly test liquid level sensing devices to ensure proper <br />operation. <br />CORRECTIVE ACTION: Liquid level sensing devices must be installed in accordance with CFR 112.8 and shall be <br />regularly tested to ensure proper operation. Immediately conduct all necessary testing of the diesel liquid level <br />sensing devices to ensure proper operation, submit test results to the EHD. <br />This is (Class 2) Violation. <br /> 62 <br />CA Health and Safety Code 25270.6(a) 4010032 - Tank Facility Statement or Business Plan has been submitted . <br />OBSERVATION: A complete tank facility statement or a business plan has not been submitted . The last submittal <br />was made January 11, 2023. <br />REGULATION GUIDANCE: (a)(1) On or before January 1, annually, each owner or operator of a tank facility subject to <br />this chapter shall file with the statewide information management system, a tank facility statement that shall identify <br />the name and address of the tank facility, a contact person for the tank facility, the total storage capacity of the tank <br />facility, and the location and contents of each petroleum storage tank that exceeds 10,000 gallons in storage <br />capacity.
