In determining whether a violation is chronic or recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 chapter 6.7 or of any regulation adopted pursuant to Ch. 6.7, not including the corrective action requirements in section 25296.10 of the Health and Safety Code and Article 11 of chapter 16 of Title 23 of the regulations.
