There is no signature or date for the Authorized Facility Management Representative, Robert Panella. There is also no signature or date for the Authorized Facility Emergency Coordinator, Augustine Calvillo. REGULATION GUIDANCE: The Plan must have the full approval of management at a level of authority to commit the necessary resources to fully implement the Plan. CORRECTIVE ACTION: Immediately obtain required management approval for the SPCC Plan for this facility. Provide proof of correction to the EHD. ---------------------------------------------------------------------------------------------------------- OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan reviewed at the time of inspection, dated June 2023, did not follow the order or requirements of 40 CFR Part 112.7. It doesn't include adequate cross- reference. Section 4.1 Compliance with Applicable Requirements- mentions that Appendix F indicates the facility inspection schedule. Instead, Appendix F is a blank page titled "Records of Tank Integrity and Pressure Tests". REGULATION GUIDANCE: If you are the owner or operator of a facility subject to this part you must prepare a Plan in accordance with adequate cross reference. CORRECTIVE ACTION: Ensure that your SPCC Plan complies with the following requirements: It follows the required SPCC rule sequence and/or includes adequate cross-reference. Provide proof of correction to the EHD. This is a (Minor)Violation. 22 Code of Fed Regulations 112.7(a)(3vi), 112.7(a4) 4010017- SPCC contains procedures for reporting a discharge OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan Emergency Contact list failed to include the phone number for the San Joaquin County Environmental Health Department. Additionally, the phone number was not included elsewhere in the SPCC plan. REGULATION GUIDANCE: The SPCC plan shall include: (vi) Contact list and phone numbers for the facility response coordinator, National Response Center, cleanup contractors with whom you have an agreement for response, and all appropriate Federal, State, and local agencies who must be contacted in case of a discharge as described in § 112.1(b). CORRECTIVE ACTION: Immediately amend the SPCC Plan to include the phone number of the Environmental Health Department of San Joaquin County. Submit proof of correction to the EHD.
