Aboveground Petroleum Storage Act Program Inspection Report <br />Date: <br />August 19, 2025 <br />Facility Address: <br />3807 Coronado AVE, StocktonSprint United Managemnt Co. <br />Facility Name: <br />Environmental Health Department <br />6 Code of Fed Regulations 112.3(d)(1) 4010045 - A professional engineer made all required attestations in the SPCC <br />Plan <br />OBSERVATION: The facility failed to ensure that a professional engineer makes all required attestations in the SPCC <br />Plan as listed in 40 CFR 112.3(d)(1). The Professional Engineer Certification page does not address the following <br />required attestations: <br />-Procedures for required inspections and testing have been established. <br />-The Plan is adequate for the facility. <br />REGULATION GUIDANCE: (1) By means of this certification, the Professional Engineer shall attest: <br />(i) That he is familiar with the requirements of § 112.3; <br />(ii) That he or his agent has visited and examined the facility; <br />(iii) That the Plan has been prepared in accordance with good engineering practice, including consideration of applicable <br />industry standards, and with the requirements of this part; <br />(iv) That procedures for required inspections and testing have been established; and <br />(v) That the Plan is adequate for the facility <br />(vi) That, if applicable, for a produced water container subject to § 112.9(c)(6), any procedure to minimize the amount of <br />free-phase oil is designed to reduce the accumulation of free-phase oil and the procedures and frequency for required <br />inspections, maintenance, and testing have been established and are described in the Plan. <br />CORRECTIVE ACTION: Ensure that the SPCC plan includes all required professional engineer's certification and <br />attestations. Submit proof of correction to the EHD. <br />This is a (Minor) Violation. <br />7 Code of Fed Regulations 112.5(a), 112.5(b) 4010010 - Facility has amended SPCC as necessary <br />OBSERVATION: The facility failed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan within six <br />months of when there was a change in design, construction, operation, or maintenance, which affects the facility’s <br />discharge potential. <br />-The plan was not amended within six months of onsite review. The SPCC Plan includes an "Onsite Review and <br />Evaluation Checklist" document dated 3/23/21 with "I will amend" indicated at the end. The date of the next review on the <br />review log (Appendix C) and the PE certification included in the plan are dated 12/20/21, nine months later. <br />-The plan was not amended to reflect changes in personnel, including the management approval, the emergency contact <br />list, and the designated facility response coordinator. <br />-The plan was not amended to reflect changes in total aboveground storage capacity. The table listing all containers still <br />includes the "Portable Generators (up to 20 units maximum" with a maximum capacity of 4,000-gallons. Data Center <br />Operations Manager Juan Aguilera stated that the portable generators were removed from the site before he began <br />working for the company in May 2024. <br />REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in § <br />112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility design, <br />construction, operation, or maintenance that materially affects its potential for a discharge as described in § 112.1(b). <br />CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents facility <br />design, procedures, and policies currently in place. Provide proof of correction to the EHD. <br />This is a (Class 2) Violation. <br />1868 E.
