North County Recycling Center and Sanitary Landfill Permit Revision Project
Final Initial Study/Mitigated Negative Declaration · San Joaquin County | May 2025
67

sacred place, or object with cultural value to a California Native American tribe, and
that is:
i) Listed or eligible for listing in the California Register of Historical Resources,
or in a local register of historical resources as defined in Public Resources
Code section 5020.1(k)?
ii) A resource determined by the lead agency, in its discretion and supported by
substantial evidence, to be significant pursuant to criteria set forth in
subdivision (c) of Public Resources Code section 5024.1? In applying the
criteria set forth in subdivision (c) of Public Resources Code section 5024.1,
the lead agency shall consider the significance of the resource to a California
Native American tribe.
Less-than-Significant Impact with Mitigation Incorporated

The potential exists for unknown tribal cultural resources to be discovered during earth-
disturbing landfill activities, such as excavation, that could occur in the course of future
operational activities. Thus, the project would have a potentially significant impact.
MITIGATION MEASURES
Implementation of Mitigation Measure CUL-1 (see Section 4.2.5, Cultural Resources) would
ensure that any accidentally discovered tribal cultural resources would be treated with proper
care during future ground-disturbing activity at the project site. With implementation of
Mitigation Measure CUL-1, the project’s potential impact would be reduced to a less-than-
significant level.
