<br /> <br /> <br />Memorandum <br />March 25, 2025 <br />Page 7 <br />21202-23 North County Landfill_AQ_0307 <br />Valley Air District has implemented these plans and adopted nearly 650 rules that have resulted <br />in significant emissions reductions. Specific rules applicable to the proposed project include the <br />following: <br />• Rule 2201 (New and Modified Stationary Source Review Rule). This rule, also known as <br />New Source Review, applies to all new stationary sources and all modifications to <br />existing stationary sources which are subject to the Valley Air District permit <br />requirements and after construction emit or may emit one or more regulated pollutant <br />(e.g. criteria air pollutants and precursors). This rule requires new and modified <br />stationary sources to mitigate emissions using Best Available Control Technology and to <br />offset emissions when estimated emissions are above specified thresholds. Valley Air <br />District implementation of New Source Review ensures that there is no net increase in <br />emissions above specified thresholds from new and modified Stationary Sources for all <br />nonattainment pollutants and their precursors. <br />• Rule 4102 (Nuisance). This rule prohibits discharge of air contaminants or other <br />materials which cause injury, detriment, nuisance or annoyance to any considerable <br />number of persons or to the public or which endanger the comfort, repose, health or <br />safety of any such person or the public or which cause or have a natural tendency to <br />cause injury or damage to business or property. <br />• Rule 4642 (Solid Waste Disposal Sites). This rule limits volatile organic compound <br />emissions from solid waste disposal sites. <br />• Regulation VIII (Fugitive PM10 Prohibitions). This regulation consists of a series of rules <br />requiring the implementation of dust control measures to reduce fugitive dust <br />emissions generated by human activity. <br />Consistent with CEQA Guideline Appendix G, the Valley Air District has adopted thresholds of <br />significance to assist lead agencies in the evaluation and mitigation of air quality impacts under <br />CEQA (CEQA Guidance).4 The District’s thresholds establish levels at which emissions of ozone <br />precursors (ROG and NOx), PM10, PM2.5, carbon monoxide, sulfur oxides (SOx), TACs, and odors <br />could cause significant air quality impacts.
