Per the truck driver,the release has an odor of vinegar. At <br /> this time unknown substance and quantity. <br /> OBSERVATIONS: <br /> Arrived on site at the leaker area of the UPRR yard at 1000 E. Roth Road and observed leaking from container HGIU <br /> 201188. Active leaking was observed from the bottom of the container and created a puddle with an approximate size of six <br /> inches by one foot. Inside the container a pallet of batteries was observed tipped over causing the release of the battery <br /> acid. Met with Nolan Ryan the Field Supervisor for Patriot Environmental Services. Nolan Ryan said he took a pH of the <br /> spill and it had a pH of 0-1. Patriot Environmental Services will be conducting the clean-up for Hub Group. Nolan Ryan <br /> stated that they will re-palletize the unbroken batteries. Broken batteries will be disposed of. Acid will be neutralized with <br /> sodium bicarbonate and the floor of the container, outside bottom of container and cement will be cleaned up and waste <br /> generated disposed of. Waste will be kept on site until disposal. Hub Group to provide SJC EHD with disposal records for <br /> the waste generated. <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> ° Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Other Correction <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
