WASTE DISCHARGE REQUIREMENTS ORDER NO. R5-2010-0016 -19- <br />SAN JOAQUIN COUNTY DEPARTMENT OF PUBLIC WORKS <br />NORTH COUNTY LANDFILL <br />SAN JOAQUIN COUNTY <br /> <br /> <br />Provision E.25.c requires that the Discharger provide an updated cost estimate, as <br />necessary under these WDRs, for corrective action, while Provision H.5.c requires <br />that the Discharger provide and maintain updated F/As to the CIWMB in the <br />amount of the updated cost estimate, as approved by the Regional Water Board. <br />Provision G.11 further requires that initially, and at least every five years thereafter, <br />the Discharger submit a report to the Regional Water Board’s Executive Officer as <br />to the ongoing viability of F/A instruments and, on an annual basis, evidence of <br />acceptance by the CIWMB of its required annual demonstration under Title 27. <br /> <br />CEQA AND OTHER CONSIDERATIONS <br />70. The action to revise the WDRs is exempt from the provisions of the California <br />Environmental Quality Act (Public Resources Code Section 21000, et seq.), in <br />accordance with Title 14, CCR Section 15301 for existing facilities. <br />71. The San Joaquin County Board of Supervisors certified a final environmental <br />impact report (EIR) addressing plans for vertical expansion of the landfill (San <br />Joaquin County Department of Public Works, Final Environmental Impact Report <br />for North County Recycling Center and Sanitary Landfill, prepared by Jones & <br />Stokes; State Clearinghouse No. 2006062113) on 5 December 2006. The San <br />Joaquin County Clerk filed a Notice of Determination on 11 December 2006 in <br />accordance with the California Environmental Quality Act (Public Resources Code <br />Section 21000 et seq.) and CEQA guidelines (14 CCR Section 15000 et seq.). <br />The report found that the vertical expansion project would not have a significant <br />impact on landfill waste containment facilities and controls nor on water quality <br />provided compliance with applicable state and federal regulations and permit <br />requirements is maintained (i.e., Subtitle D, Title 27, NPDES storm water, landfill <br />WDRs). These WDRs implement such regulations. See Finding 74. <br />72. Section 13267(b) of California Water Code provides that: “In conducting an <br />investigation specified in subdivision (a), the Regional Water Board may require <br />that any person who has discharged, discharges, or is suspected of discharging, or <br />who proposed to discharge within its region, or any citizen or domiciliary, or <br />political agency or entity of this state who had discharged, discharges, or is <br />suspected of discharging, or who proposed to discharge waste outside of its region <br />that could affect the quality of the waters of the state within its region shall furnish, <br />under penalty of perjury, technical or monitoring program reports which the <br />Regional Water Board requires. The burden, including costs of these reports, shall <br />bear a reasonable relationship to the need for the reports and the benefits to be <br />obtained from the reports.” The monitoring and reporting program required by this <br />Order (MRP No. R5-2010-0016, attached) is necessary to assure compliance with <br />these waste discharge requirements. The Discharger owns and operates the <br />facility that discharges the waste subject to this Order. <br />
