During this “proof period”, the Discharger shall <br />demonstrate that: <br />a. The concentration of each constituent in each sample from each <br />monitoring point remained at or below its concentration limit for at least <br />three years, beginning immediately after the suspension of corrective <br />action measures; and <br />b. The individual sampling events for each monitoring point must have been <br />evenly distributed throughout the proof period and have consisted of at <br />least four sampling events per year per monitoring point (i.e., quarterly <br />monitoring). <br />c. At the end of the proof period, a single data analysis method (statistical or <br />nonstatistical, as appropriate) shall be used for each monitoring parameter <br />at each monitoring point to determine whether that parameter has been <br />reduced to levels at or below concentration limits at that monitoring point. <br />The Discharger shall notify the Board and obtain Executive Officer approval <br />prior to (1) suspending corrective action measures prior to making the above <br />demonstration; and (2) terminating corrective action measures after making <br />the above demonstration. <br />33. Any proposal for concentration limits greater than background (CLGBs) shall <br />be accompanied by the requisite demonstration under Section 20400(c) (i.e., <br />that it is technologically or economically infeasible to achieve the background <br />value for that constituent and that the constituent will not pose a substantial <br />present or potential hazard to human health or the environment). Approval of <br />CLGBs shall require approval of revised WDRs by the Regional Water Board. <br />F. REPORTING REQUIREMENTS <br />1. The Discharger shall comply with the reporting requirements specified in this <br />Order, MRP No. R5-2010-0016, and the SPRR. <br />2. The Discharger shall immediately notify the Regional Water Board of any <br />flooding, unpermitted discharge of waste off-site, equipment failure, slope <br />failure, or other change in site conditions that could impair the integrity of <br />waste or leachate containment facilities or precipitation and drainage control <br />structures. <br />3. If monitoring reveals substantial or progressive increases of leachate <br />generation above the design leachate flow by the Unit or portion of the Unit, <br />such that the depth of fluid on any portion of the LCRS (excluding the leachate <br />removal pump sump) exceeds 30 cm, the Discharger shall immediately notify <br />the Board in writing within seven days.
