SAN JOAQUIN <br /> Environmental Health Department <br />---COUNTY <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: LOUP LOGISTICS <br />Date: Jul 16, 2018 <br /> <br />RP Mailing Address: 1400 DOUGLAS STREET, MS 1420 <br />Record ID#: C00047089 <br />Omaha, NE 68179- Program Element: 2546 <br /> <br />Spill Location: 1000 E ROTH RD, FRENCH CAMP Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />One gallon of paint was spilled. <br />OBSERVATIONS: <br />Arrived on site and met with Nolan Ryan from Patriot Environmental. Car UPHZ 155388 was observed with liquid dripping <br />on the ground (towards the middle of the car). The liquid that was leaking had a pH between 0-1. Nolan thought that the <br />liquid was battery acid. He informed me that he was going to be cleaning up the waste by using sodium bicarbonate. <br />Clean-up was not complete while I was on site. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Submit copies of the final disposal records to the EHD within 30 days. A complete hazadous waste determine will need <br />to be made. If the waste is deemed non-hazardous, submit documents to the EHD showing why the waste is <br />non-hazardous. <br />Other Correction <br />COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br />rate.
