SAN_ 10 A Q U I N Environmental Health Department <br />V <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: WERNER Date: Apr 26, 2018 <br />RP Mailing Address: 14507 FRONTIER ROAD Record ID#: C00046456 <br />Omaha, NE 68138- Program Element: 2546 <br />Spill Location: 1000 E ROTH RD, FRENCH CAMP Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />On 4/25/2018 there was a release of approximately two gallons of diesel from a rail car onto asphalt. The spill occurred <br />around 9:06 a.m. No waterways or storm drains were impacted. Contractors are currently responding for clean up. <br />OBSERVATIONS: <br />Arrived on site and observed approximately 2 gallons of Diesel on the ground. Refrigeration car WERZ27910 was not <br />leaking when I arrived. The spill was contained to the concrete. NRC (cleanup contractor) put absorbent on the spill. The <br />spill was properly cleaned up. The hazardous waste drum was properly labeled and kept on site for the responsible party to <br />have disposed. <br />TIONS: <br />• Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />El Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />• Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />El Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />RRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />• Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Submit final hazardous waste manifests immediately upon being received. <br />Other Correction <br />COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br />rate.
