MATERIAL WAS DETERMINED TO BE SOMETHING CALLED"LITTLE CAESARS 81 <br /> ORANGE."THERE WAS NO SDS OR DOCUMENTATION TO SUPPORT THE CONCLUSION MATERIAL IS <br /> NON-HAZARDOUS. <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> • Other Violation <br /> Failure to provide an acceptable Hazardous Waste Determination to the EHD. <br /> It is the hazardous waste generator's responsibility to determine if a waste is hazardous or not[22 CCR§66262.11]. <br /> The information a generator may use to classify a waste includes: (1) knowledge of materials and processes used (e.g. <br /> material safety data sheets and process flow diagrams)and (2)analytical testing data(i.e. hazardous waste analysis). <br /> If a generator is unfamiliar with their chemical processes and/or they cannot adequately explain whether an associated <br /> waste stream is hazardous or not,then a hazardous waste analysis should be conducted.This entails collecting <br /> representative samples of the waste and having it chemically analyzed at a state-certified environmental laboratory. <br /> ORRECTIVE ACTIONS I ORDER: <br /> Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> El Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> • Other Correction <br /> Submit a Hazardous Waste Determination to the EHD. <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
