Facility personnel shut down the motor and stooped the release. Stained ground and <br /> stained shipping container were noted upon arrival. Union Pacific Railroad retained NRC on behalf of the shipper to <br /> implement spill clean up; clean up commenced on 8-24-2018 and was finalized on 8-25-2018. Please be advised that the <br /> disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility which is not <br /> permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a)] A hazardous waste determination [CCR. <br /> 66262.11] must be made for the generated clean up debris; dispose of all generated waste materials under the appropriate <br /> waste manifesting procedure[HSC 25160 (b)(3)] and provide waste disposal records to the EHD for all clean up debris as <br /> soon as possible. <br /> VIOLATIONS: <br /> ® Discharge of any Waste, including Sewage <br /> (CA Health and Safety Code 5411) <br /> ❑ Discharge of Waste or Sewage to Water or within 150' of Waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> ❑ Improper Disposal of a Hazardous Waste <br /> (CA Health and Safety Code 25189.5) <br /> ❑ Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ❑ Other: <br /> CORRECTIVE ACTIONS/ORDER: <br /> Immediately contain, clean up, and dispose of the waste at an authorized, permitted location. <br /> Ensure that clean up personnel possess adequate training. <br /> ❑ Investigate and abate contamination under the oversight of the appropriate lead agency. <br /> ® Submit copies of hazardous waste manifests/disposal records to the EHD within 30 days. <br /> ❑ Other: Correct By: Immediately <br /> COST RECOVERY:All EHD Staff Time Associated with this Spill Response is Billed to the Responsible Party at <br /> the Current Hourly Rate.
