J O A Q U I N Environmental Health Department <br /> COUNTY <br /> WASTE DISCHARGE/SPILL RESPONSE <br /> NOTICE TO ABATE <br /> Responsible Party: SAVAGE SERVICES Date: Dec 04, 2018 <br /> RP Mailing Address: 833 E 8TH ST Record ID#: COBYIRGRX <br /> Stockton, CA 95206- Program Element: 2546 <br /> Spill Location: 1000 E ROTH RD, LATHROP Release/Spill Response(excluding Joint Team) <br /> NATURE OF WASTE DISCHARGEIWASTE RELEASE: <br /> Approximately 1/4 gallon of diesel fuel was released by a bad gasket. The release has been stopped and contained. <br /> OBSERVATIONS: <br /> Spoke with Cameron McGovern, Environmental Field Operations Manager, from Union Pacific. He stated that the waste(2 <br /> absorbent pads)was taken to the 833 E Eight street facility to be disposed of in the oily debris bin. The waste is going to be <br /> disposed of as nonhazardous. Cameron said that the diesel debris can go into the bin and that a profile has been done for <br /> the waste. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> ° Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> • Other Correction <br /> The diesel spill was cleaned up using two absorbent pads and placed into a nonhazardous waste drum at the 833 E <br /> Eight St Union Pacific location. No further follow up action is required by the EHD. <br /> COST RECOVERY.- All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br /> rate.
