During a load shift, approximately 20 gallons of liquid was spilled <br /> onto other containers. The release has been stopped and contained. Cleanup is in progress through a contractor. <br /> OBSERVATIONS: <br /> Approximately 50 gallons of Chain Lubricant spilled inside a shipping container#EMHU 654215.The spill impacted some of <br /> the load inside the container,the container itself, another container was beneath this container, and the concrete. No <br /> storms drains or water ways were impacted Cleanup is ongoing by American Integrated Services. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> ORRECTIVE ACTIONS 1 ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> within 30 days. <br /> • Other Correction <br /> Contact SJC EHD to witness the cleanup. <br /> COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br /> rate.
