Met <br /> with Capt.Joe McGuffin(Nor-Cal marine ops manager for NRC). He stated that a hydrualic arm on a crane broke while <br /> lifting a rail container, causing about 8 gallons of hydraulic fluid to leak onto the container and then subsequently onto the <br /> ground. <br /> -The spill onto the ground was cleaned with solid absorbents and the spill onto the container was cleaned with rags. Three <br /> 55 gallon drums of contaminated solid absorbent and one 55 gallon drum of contaminated rags was generated. <br /> -Did not see any staining at the spill site or on the affected container <br /> -No injuries were reported <br /> -The four drums of potentially hazardous waste will remain on site until testing is done. Testing will be done by Test <br /> America within the next 20-30 days <br /> -The spill did not occur near any drains sewers schools or residential areas <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> ° Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> El Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Provide documentation showing that the contaminated absorbent and rags is either hazardous or non-hazardous.
