Labeled latex paint and debris. Container will <br /> be kept on site at 1000 E. Roth Rd. for profiling. Disposal method will be determined based on profiling. <br /> All generated clean up wastes must be transported according to all applicable manifesting procedures(HSC25160(b)(3)) <br /> and disposed of according to all applicable Title 22 regulations.The disposal of any hazardous waste, or the causing <br /> thereof, is prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br /> HSC25189.5(a),I <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> ° Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> CORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Please manage all waste paint and debris according to Title 22 California Code of Regulations for hazardous waste, if <br /> profiling suggest the waste to be hazardous waste.
