Water Boards <br />Central Valley Regional Water Quality Control Board <br />26 March 2025 <br />VIA EMAIL <br />Osvaldo Cordero <br />Environmental Manager <br />Forward Landfill <br />9999 South Austin Road <br />Manteca, CA 95336 <br />GAVIN Nmsou <br />6owNNnN <br />YANA GANCIA <br />ENVIRONMENAL <br />PROTECTION <br />NV <br />REVIEW AND CONCURRENCE WITH REVISED COST ESTIMATE FOR FINANCIAL <br />ASSURANCE, FORWARD LANDFILL; SAN JOAQUIN COUNTY <br />Forward Inc., a subsidiary of Republic Services (Discharger), owns and operates the <br />Forward Landfill in San Joaquin County (Landfill). Waste disposal operations, Landfill <br />closure, implementation of corrective actions and groundwater remediation at the <br />Landfill is regulated by Waste Discharge Requirements Orders R5-2003-0080 and R5- <br />2024-0002 (collectively, WDRs) and Cleanup and Abatement Order R5-2017-0703 <br />(CAO). <br />On 22 November 2024, the Regional Board issued a Notice of Violation for an <br />incomplete submittal of Financial Assurance for the Forward Landfill. The NOV required <br />Forward to submit an updated and revised cost estimate for initiating and completing <br />corrective actions of all known or reasonably foreseeable releases. The revised cost <br />estimates must consider the future costs to clean up groundwater north of the Austin <br />Road unit and other potential releases from the expanding landfill footprint. <br />Central Valley Water Board staff has reviewed the revised cost estimate submitted on <br />3 March 2025 for cleanup of impacted groundwater north of the Forward Landfill and <br />potential releases from the expanding landfill footprint. The revised cost estimate of <br />$40,711,000 is acceptable to the Regional Board. <br />Central Valley Water Board staff reached out to CalRecycle to ask if there is anything <br />that needs to happen with their Financial Assurance requirements for the Discharger to <br />comply with Title 27. At this time, Republic Services now needs to immediately contact <br />Ms. Jonalyn Bajurin, a Supervisor with the Financial Assurances Unit at CalRecycle to <br />establish the appropriate funding mechanism outlined in Title 27.
