This report replaces the initial report, and includes violation SJC Ordinance Code Sections <br /> 9-1125.3, 9-1125.4(Discharge of waste within 150 ft.of waterway. It shall be unlawful to dump or discharge any waste <br /> within one hundred and fifty feet(150')of the high water mark of any watercourse or impoundment for either natural or <br /> unnatural surface water). This water treatment plant receives water from aqueducts, and contains concrete ponds with <br /> unnatural surface water. <br /> Observed diesel on adjacent soil,concrete,and storm drains. Could not determine exact amount released.According to site <br /> personnel, storm drain is onsite, and leads to an onsite retention pond. Did not observe diesel in retention pond. Clean <br /> Harbors was contracted to perform cleanup. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> • Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> ° Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> ° Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> CORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Clean soil, concrete, and storm drain to remove diesel contaminants. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Obtain an EPA ID number, and provide disposal manifests once received. <br /> ° Other Correction <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
