Facility failed to <br /> provide training to Paula in 2022 and to Ralph, Rudy and Paula in 2023. Training should include the following: <br /> 1.The operation and maintenance of equipment to prevent discharges. <br /> 2. Discharge procedure protocols. <br /> 3.Applicable pollution control laws, rules, and regulations. <br /> 4. General facility operations. <br /> 5. The contents of the SPCC Plan. <br /> REGULATION GUIDANCE: (f)(1)At a minimum,train your oil-handling personnel in the operation and maintenance of <br /> equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br /> regulations;general facility operations; and,the contents of the facility SPCC Plan. <br /> CORRECTIVE ACTION: Immediately provide adequate training to all oil handling personnel and submit a copy of the <br /> training log and training content to the EHD. <br /> This is (Minor)Violation. <br /> 79 CA Health and Safety Code 25404(e)(4)4010-Administration/Documentation-General. <br /> OBSERVATION:A submission to the California Environmental Reporting System (CERS)for the Aboveground <br /> Petroleum Storage Act(APSA)program has been late the last 2 years. APSA submittals are due within one year from <br /> December 17,2024. Your 2025 submittal was dated April 22, 2024 therefore,April has become your new due date <br /> going forward. <br /> REGULATION GUIDANCE:25404(e)(4)No later than three years after the statewide information management system <br /> is established, each CUPA, PA, and regulated business shall report program data electronically. The secretary shall <br /> work with the CUPAs to develop a phase-in schedule for the electronic collection and submittal of information to be <br /> included in the statewide information management system, giving first priority to information relating to those <br /> chemicals determined by the secretary to be of greatest concern. The secretary, in making this determination shall <br /> consult with the CUPAs,the California Emergency Management Agency,the State Fire Marshal, and the boards, <br /> departments, and offices within the California Environmental Protection Agency. <br /> CORRECTIVE ACTION: Beginning January 1, 2013, all businesses are required to submit all new(or any changes to <br /> existing)Aboveground Petroleum Storage Act (APSA)information online to the CERS at http://cers.calepa.ca.gov. Be <br /> sure to include your APSA activity in the Businesses Activities section in CERS in addition to any other relevant <br /> activities and required fields.
